Welcome. These Terms of Service govern your access to and use of The Harp Lab website and services. By using the site or making a purchase or booking, you agree to be bound by these Terms.

1. About us

The Harp Lab (“we”, “us”, “our”) is a sole trader operating from:

2. Scope and acceptance

These Terms apply to all users of the site, including browsers, customers, vendors, and contributors. By accessing or using any part of the site, or placing an order or booking, you accept these Terms. If you do not agree, do not use the site or services.

3. Changes to these Terms

We may update these Terms at any time. The most current version will be posted on this page. It is your responsibility to review the Terms periodically. Continued use after changes means you accept the updated Terms.

4. Services and products offered

We offer:

• Harps and harp accessories for sale

• Physical music recordings for sale

• Harp rental services

• Harp performance services (weddings, corporate events, private events)

Product availability, descriptions, prices, and service offerings may change without notice.

5. Eligibility and permitted use

You confirm you are of legal age to form a binding contract in your jurisdiction, or you have parental consent. You may not use our services for unlawful or unauthorized purposes, or violate any applicable laws.

6. Orders, bookings and account information

You may place orders or book services through the website or via manual/invoice booking. You agree to provide current, complete and accurate information for orders and bookings and to update any account details as needed. We reserve the right to refuse or cancel orders or bookings at our discretion (for example, suspected fraud or stock unavailability). If we cancel, we will notify you and refund any amounts paid.

7. Pricing and payment

Prices shown on the site are in AUD unless otherwise stated. Acceptable payment methods include Stripe, PayPal and Afterpay. Payment terms depend on the product or service:

• Product sales: full payment or deposit + balance as agreed.

• Rentals: full payment typically required upfront.

• Performance bookings: deposit to secure date, balance due as agreed or after performance if previously arranged.

You are responsible for all taxes, duties, or other government charges unless otherwise stated.

8. Shipping and delivery

Physical products will be shipped to the address you provide. Shipping times and costs depend on courier and location. We are not responsible for carrier delays. Risk passes to you when the product is delivered to the carrier, except as otherwise required by law.

9. Returns, refunds and rescheduling

Product sales: Returns accepted within 14 days of receipt if items are unused and in original condition. Shipping costs are non-refundable. Refunds will be processed to the original payment method within 5–10 business days after we receive and inspect the returned item.

Performances and bookings: Rescheduling is offered for illness and related emergencies with at least 24 hours’ notice. Refunds or cancellations for bookings are handled case by case, and any deposit policy agreed at booking will apply. Damage, late cancellations, or no-shows may result in forfeiture of deposit as per the booking agreement.

10. Rentals

Rental items must be returned in the same condition as received. Customers are responsible for reasonable care during the rental period. Damage, loss or excessive cleaning fees may be charged.

11. Intellectual property and recordings

We own or control all website content, photos, recordings, arrangements, branding and written material unless otherwise stated. Clients may not reproduce, distribute or publish such material without our written permission. We may request permission to use photos or videos from performances for marketing; we will obtain your consent first. Ownership of client recordings or commissioned arrangements will be set out in separate agreements where necessary.

12. User submissions, feedback and conduct

If you send suggestions or content to us, you grant The Harp Lab a perpetual, royalty-free, worldwide license to use, edit and reproduce the material. You must not upload or submit anything unlawful, infringing, defamatory or harmful.

13. Third-party tools and links

We may provide access to third-party tools and links. We do not control third-party content and are not responsible for it. Use third-party services at your own risk and review their terms.

14. Warranties and disclaimers

Except as expressly stated, our services, products and website are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free service. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

15. Limitation of liability

To the maximum extent permitted by law, The Harp Lab and its officers, employees and contractors will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or business opportunity arising from your use of the site or services. Where liability cannot be excluded, it is limited to the maximum extent permitted by applicable law.

16. Indemnity

You agree to indemnify and hold The Harp Lab harmless from any claims, losses, liabilities or expenses arising from your breach of these Terms or your use of the services.

17. Termination

We may terminate or suspend access to the site or services for users who breach these Terms or who we reasonably suspect of fraudulent or abusive behaviour. Termination does not limit our other rights or remedies.

18. Severability and entire agreement

If a provision of these Terms is unenforceable, it will be modified to the minimum extent necessary and the rest of the Terms will remain in force. These Terms, together with our Privacy Policy and any other policies posted on the site, constitute the entire agreement between you and us.

19. Governing law and jurisdiction

These Terms are governed by the laws of Australia. You agree that Australian courts will have non-exclusive jurisdiction over any dispute unless otherwise required by law.
